  • GENERAL TERMS AND CONDITIONS OF SALE 


    1. Service Provider Identification
    These General Terms and Conditions of Sale apply to the services provided by:
    Esprit Rivières
    Guillaume Mary
    Certified Fishing Guide and Canoe-Kayak Instructor & Related Disciplines
    (hereinafter referred to as “the Service Provider”)

    2. Purpose
    These General Terms and Conditions define the conditions under which the Service Provider offers fly fishing guiding services, as well as fishing and kayaking outings, for individuals or groups.
    Any booking implies the client’s full and unconditional acceptance of these General Terms and Conditions.

    3. Services Provided
    The Service Provider offers, in particular:
    guided fly fishing outings,
    fishing activities in natural environments,
    kayaking outings and guiding (depending on the services offered),
    instruction, coaching, and skill development services.
    The content, duration, and location of the services are defined at the time of booking.

    4. Participation Requirements
    The services are open to any person:
    whose physical condition is compatible with the activity,
    who is able to swim for kayaking activities,
    who agrees to comply with the safety instructions given by the Service Provider.
    Minors must be accompanied by a responsible adult, unless prior written agreement is given.

    5. Booking
    Bookings may be made:
    by telephone or after direct contact with the Service Provider.
    A booking becomes final once it has been confirmed by the Service Provider and, where applicable, after payment of a deposit.

    6. Prices and Payment Terms
    Prices are expressed in euros (€) and communicated prior to any booking.
    Unless otherwise stated:
    payment may be made in cash, by bank transfer, or by any other accepted method,
    the balance is payable on the day of the activity.
    Prices do not include, unless otherwise specified:
    the mandatory fishing licence,
    the client’s travel expenses to the meeting point,
    meals and personal expenses.

    7. No Right of Withdrawal
    In accordance with Article L221-28 of the French Consumer Code, leisure services provided on a specific date are not subject to a right of withdrawal.

    8. Cancellation and Postponement
    Cancellation by the Client
    Any cancellation must be communicated as soon as possible.
    In the event of cancellation less than 15 days before the activity, the deposit paid will be retained.
    In the event of a no-show, the full amount of the service will be due.
    Cancellation or Postponement by the Service Provider
    The Service Provider reserves the right to cancel or postpone an activity for safety reasons, particularly in the event of:
    adverse weather conditions,
    unsuitable water levels,
    force majeure.
    In such cases, a new date will be proposed.

    9. Safety and Liability
    The Service Provider undertakes to supervise activities in compliance with applicable safety regulations.
    The client undertakes to:
    strictly follow the instructions given,
    use the safety equipment provided,
    inform the Service Provider of any relevant medical condition.
    The Service Provider cannot be held liable for damage resulting from:
    failure to comply with instructions,
    reckless or dangerous behaviour,
    loss or damage to personal belongings.

    10. Insurance
    The Service Provider is covered by professional civil liability insurance.
    Clients are strongly advised to hold personal insurance covering outdoor activities, including fishing and kayaking.

    11. Image Rights
    Unless the client objects prior to the activity, the Service Provider is authorised to use photographs or videos taken during the activity for communication and promotional purposes, without time limitation or financial compensation.

    12. Personal Data
    Personal data collected are used exclusively within the framework of the commercial relationship.
    In accordance with the GDPR, clients have the right to access, rectify, and delete their personal data.

    13. Applicable Law and Disputes
    These General Terms and Conditions are governed by French law.
    In the event of a dispute, an amicable solution will be sought as a priority.
